06/15/09 - No surprise as E-Verify Requirements are delayed until September 2009

The delay of the E-Verify requirement for federal contractors until September 8, 2009 is likely no surprise to affected organizations. Although the requirement was originally scheduled to go into effect on January 15, 2009, the June 2nd announcement is the fourth delay in the implementation. Absent another delay, employers who are federal contractors must use the E-Verify system for all federal contracts awarded after September 8th that have a value of greater than $100,000 and a performance time exceeding 120 days.

The key requirement is that employers who are federal contractors must use the E-Verify internet-based database for each newly hired employee. The current requirement is that the employers must be using the revised Form I-9 to verify information on new hires.
