Legal experts are predicting that litigation against employers will continue to increase as employee layoffs continue to occur. With a vast majority of the working population out of work, laid-off workers become desperate for a source of income. These unemployed workers turn to litigation, accusing their former employer of anything from sexual harassment to discrimination. Although employers should be taking steps to protect themselves from this type of litigation, legal experts have found that only one-third of employers have actively increased employment and labor law training for managers and supervisors. The best way to defeat employment litigation is to have consistently practiced employment policies in place. Thus, we urge you to meet with your supervisors and managers to ensure a common understanding of employment policies.
There is good news, however, being reported in that there are fewer claims involving safety and health disputes, disputes over disability accommodations and sexual harassment claims. This illustrates that employers are finding ways to maintain safe work environments, as well as striving to comply with ADA and Title VII laws.
