Internal Workplace Investigation

It is a rare situation where an employee will honestly acknowledge any misbehavior when asked or confronted. More often the employee denies any misconduct. Failure to investigate and, if necessary, remedy such situations is very risky to employers. Conversely, hasty or careless action can also result in liability. The only viable option for most employers is to carefully assess the situation in an effort to make an informed decision based on the results of a workplace assessment. As a result of the recent Supreme Court rulings regarding harassment claims, it is even more critical that employers conduct thorough and well-documented assessment. Assessments do not only apply to harassment, but also to drug use, theft, threats, and other organization policy infractions. The fundamental challenge is that most organizations and employers are not in the investigation business.

This training program is designed for managers and supervisors since they are usually the individuals who have the responsibility for conducting assessments, often in conjunction with Human Resources. This program should assist you in leading groups to discuss this subject.

The learning materials provide participants a thorough explanation of the assessment process and information on conducting it correctly, as well as assistance in avoiding liability from legal action. Some of the areas covered include:
  • Developing Assessment Skills;
  • Identifying Types of Assessments;
  • Determining if an Assessment is Necessary;
  • Who Should Conduct the Assessment and What is Their Role;
  • Interviewing and Questioning Techniques;
  • Appropriate Documentation;
  • Analysis of Results to Make a Decision and Summary of Results;
  • What To Do After the Assessment; and,
  • Case Studies and Discussion Questions for Each Key Area.

    The training hand out materials are supported by two videos entitled Managing Internal Investigations and How to Investigate and Respond to Sexual Harassment and Other Harassment Charges. The first video, a 28-minute program, provides an overview of the steps that individuals and organizations should follow when conducting an investigation and identifies the potential pitfalls that can occur. The second video focuses on guidelines established by EEOC describing the steps employers must take, such as having a harassment policy, investigating claims quickly, ensuring confidentiality, and ensuring thorough documentation. The program will also assist in identifying what important information must be obtained during a harassment assessment. The premise behind the video is to help an organization with practical information about how to investigate and respond to claims effectively and legally
